After Iraq's transition to a new phase and the adoption of the federal system as a form of state and approve the reality of the Kurdistan Region in the constitutional document of (the law of the State Administration of Iraq for the Transitional Period), which stipulates in its principles on the rights and fundamental freedoms. It was necessary to hand the task of monitoring the legitimacy of the laws and the elimination of conflicts with the law of the State Administration of Iraq for the Transitional Period, the Article forty-fourth, including the creation of a federal court supreme mission control over the constitutionality of laws and consider the disputes to arise from the application of federal laws.

According to the provisions of Article referred to above and the approval of the Presidency Council, the Council of Ministers issued, according to the legislative powers of Order No. (30) for the year 2005 (the Federal Supreme Court Act). As stated in Article (1) of the Act include:

"Arise Court called the Federal Supreme Court and will be based in Baghdad exercise its functions independently no authority over them is the law".

As stipulated in Article (2) of the Act on the independence of the Court financially and administratively.
